Prohibited Listings Policy

Madilyn James, LLC (hereinafter, “Madilyn James,” “we,” “us,” or “our”) does not allow listings on the Madilyn James platform, including the Madilyn James website located at https://info.madilynjames.com/ (the “Site”) and mobile app (on any and all formats or devices) (the “App”) (the Site and the App, and the services, content and other materials made available through the Site and the App are referred to in these Terms of Service as the “Service”) for certain types of objectionable items listed through the Service (“Items”). This Madilyn James Prohibited Listings Policy (this “Policy”) describes the Items that you are prohibited from listing through the Service. We reserve the right to remove listings from the Service for Items that violate this Policy.

We exercise judgment in allowing or prohibiting listings and we keep our community of customers and cultural differences and sensitivities in mind when reviewing and deciding whether Items violate this Policy.

Listings for Items that we deem objectionable are prohibited on the Service. We reserve the right to determine the appropriateness of listings on the Service, and remove any listing at any time. If you list an Item on the Service in violation of this Policy, we will take corrective actions, as appropriate, which may include, but not be limited to, immediately suspending or terminating your seller privileges, destroying Items in our possession without reimbursement, returning inventory, terminating our business relationship with you, and permanently withholding payments to you (as applicable).

Listings We Prohibit Include, Without Limitation:

Violence, Intolerance, and Hate

  • Listings for slavery Items, including reproductions, such as tags, shackles, documents, bills of sale, etc.
  • Listings for Items with racist, anti-Semitic, or otherwise demeaning portrayals, for example through caricatures or other exaggerated features, including figurines, cartoons, housewares, historical advertisements, and golliwogs.
  • Listings for Black Americana Items that are discriminatory.
  • Listings for the Confederate battle flag and related Items with its image.
  • Listings for historical Holocaust-related and Nazi related Items, including reproductions.
  • Listings for any Item that is anti-Semitic or any Item from after 1933 that bears a swastika.
  • Listings for media identified as Nazi propaganda.
  • Listings that imply or promote support of, membership in, or funding of a terrorist organization.
  • Listings that promote, incite, or glorify hate or violence towards any person or group.
  • Listings that promote or glorify suicide,
  • Listings that promote or glorify people that have been found guilty of violent or sexual crimes.
  • Listings that promote intolerance based on race, religion, and/or sexual orientation.
  • Listings that contain racially derogatory language.


Human Tragedies and Disasters

  • Listings related to human tragedies and natural disasters


Child Abuse and Exploitation

  • Listings that depict child abuse/exploitation.
  • Listings intended for use by children that contain adult content, profanity and/or sexual references.
  • Listings depicting children or characters resembling children in a sexually suggestive manner.
  • Listings marketed to or targeted at kids or teenagers that are age-inappropriate.


High Risk and Hazardous Materials

  • Listings for medical implants; injectable substances; medication; or other medical devices that require a prescription or medical supervision or that can be used for unlawful purposes.
  • Listings for weapons or firearms of any type, parts and accessories for assault weapons (including blueprints and instructions), firearm receivers, and ammunition for firearms (including bullets, cartridges, casings, shells and hulls).
  • Listings for highly flammable or combustible products (such as gas tanks, propane, fireworks, flares, red phosphorous, or similar products).
  • Listings for toxic materials such as pesticides, carcinogens, poisons, ozonedepleting substances, radioactive materials, or Items that contain or release such substances.


Makeup and Personal Care Products

  • Listings for makeup and personal care Items, including personal applicators, that are used or not in new condition.
  • Listings for qualifying cosmetics and liquid products must be in new condition within original factory-sealed packaging and must be sold or removed before the expiration date has passed. Repotting, de-potting, or repackaging cosmetics is not allowed.


Socks and Underwear

  • Listings for used socks and underwear. New undergarments with tags attached are allowed to be sold in clean, unstained, and unused condition. Pre-owned bras and swimwear are allowed.


Counterfeit and Infringing Products

  • Listings for counterfeit products are illegal to buy and sell, and strictly prohibited on the Service. Often referred to as “replicas,” counterfeit Items may include fakes, knockoffs, bootlegs, and otherwise illegally replicated goods.
  • Examples of prohibited counterfeit Items include but are not limited to:
    • Branded handbags, sneakers, and sports jerseys that were not produced by a licensed manufacturer, like a purse or VIP Item bearing a designer name or logo that was not made by the designer;
    • Altered products made by embellishing, upcycling, or repurposing all or portions of trademarked and authentic branded Items to change the form or function of the original Item without the rights owner or brand’s permission, such as using material from a luxury bag to make a necklace or keychain; and/or
    • Pirated or unauthorized recordings of digital media, like movies and TV shows.


Animals

  • Listings for live animals, eggs, or any product derived from domestic cats and dogs or endangered animal species, regardless of when a product was made.
  • Listings for any animal species listed in Appendix I of the Convention on International Trade in Endangered Species (CITES) are prohibited.
  • Some examples of prohibited animal products listings include:
    • Elephant and mammoth ivory which may be found in netsuke and okimono figurines, billiard balls, game pieces, and many kinds of jewelry;
    • Marine turtle shell which may be found in bracelets, hair clips, and glasses;
    • Pangolin leather belts and boots which may be misidentified as anteater; and/or
    • Cheetah, jaguar, leopard, lion, ocelot, and tiger fur, claws, and teeth; which may be found in coats and jewelry.
